1950 Niagara Treaty

In 1950, the Canadian and United States government got together to determine specifications for water diversion from the Niagara River. The treaty, officially called the "Diversion of the Niagara River", states the following:

  • Tourist Season is defined between the hours of 8:00am and 10:00pm, April 1st through September 15, and 8:00am and 8:00pm, September 16th through October 31st. During these times, no less than 100,000 cubic feet per second can be running over the falls.
  • All other times, no less than 50,000 cubic feet per second can be running over the falls.


"All water in excess of that required for domestic and sanitary purposes, navigation, and the Falls flow may be diverted for power generation."[1]
